Who is Eligible for Free Housing Patta? High Court Verdict Explained
Madurai: The Chennai High Court Madurai Bench has ruled that free housing pattas (land titles) cannot be claimed as a matter of right. This is a welfare measure provided only to eligible poor families who do not own a house. Income criteria play a key role in eligibility, the judges said.
Many residents of Madurai had petitioned the district collector in 2022, requesting free housing pattas for the Tirupparankundram and Nilangur areas, but their requests were denied. They then approached the High Court seeking orders to grant the pattas.
The judges, S.M. Subramaniam and Mary Clad, in their verdict stated:
- Free housing pattas cannot be given to ineligible persons.
- They cannot be claimed as a property right; they are welfare assistance given on the basis of eligibility.
- Only those without any house or land and belonging to low-income groups are entitled to receive these pattas.
- Income thresholds are very important.
This ruling means that free housing pattas will not be given to encroachers or those who are not eligible. Only poor, landless, and houseless people residing on government land (non-disputed and non-waterlogged areas) for a long period will qualify.
Tamil Nadu Government Scheme Details:
- Pattas are issued to people living on government non-agricultural land without objections, who have built houses and resided there for more than 10 years.
- Usually, 3 cents of land are allotted as free housing patta.
Eligibility Criteria:
- Must be living on government land free of objections for over 5 years.
- Applicantโs name must not appear in any existing land or house records.
- Annual income must be very low, below the poverty line.
- Applicant should not own any other property.
- Must provide valid documents proving residence, income, and caste (if applicable).
Required Documents:
- Proof of no ownership of any land or house.
- Proof of residence (family ID, Aadhaar card, passport-sized photos).
- Income certificate.
- Caste certificate (if applying under quota).
- Application should clearly mention the area where the patta is requested.
Application Process:
- Submit the application to the District Collectorโs office.
- Local revenue officers will verify that the land is government-owned and free of objections.
- After verification, the patta will be issued.
